Allgemeine Geschäftsbedingungen

§ 1 Scope

(1) These General Terms and Conditions (hereinafter “GTC”) apply to the use of the platform lila (hereinafter “Lila”), operated by Philip Müller, Tobias Kullmann & Hendrik Müller lila GbR, based in Leipzig. They govern the rights and obligations of users (interested parties and providers) in connection with the use of the platform.

(2) For the business relationship between Lila and its users, only the GTC in their respective current version shall apply. Deviating general terms and conditions of the users shall not be recognized unless Lila expressly agrees in writing to their validity.

(3) By using the platform, the user accepts the GTC in their respective current version. Lila reserves the right to modify the GTC. Lila will publish any changes to the GTC on its website at least 30 days before they come into effect. The proposed changes shall only take effect if the user agrees to them. If the user does not agree, Lila shall have the termination right provided in § 8 Paragraph 2.

§ 2 Services Provided by Lila

(1) Lila operates an online platform for the presentation, search, and recommendation of artworks and artistic objects as well as furniture products and interior furnishing elements (hereinafter collectively referred to as “artworks” or “products”, respectively). The platform particularly offers the following functions:

  1. Providers have the opportunity to present and promote artworks and products,
  2. Providers have the opportunity to link to their own website for redirection,
  3. Interested parties have the opportunity to find and discover artworks and products using various search functions,
  4. Interested parties have the opportunity to receive personalized recommendations for artworks as well as for products,
  5. Interested parties have the opportunity to send providers contact requests that may include a price proposal.

This list is not exhaustive. Lila reserves the right to expand the services.

(2) Providers may, in particular, be:

  1. Artists who present their own works,
  2. Galleries that present works by the artists they represent,
  3. Art marketplaces that are entitled to present works by various artists,
  4. Furniture dealers and suppliers of interior design who are entitled to present furniture products and furnishing elements, or
  5. Other institutions or companies that are entitled to present artworks or furniture products.

This list is not exhaustive. Lila reserves the right to allow further types of providers, provided that they are authorized to present artworks or products. Providers warrant that they possess the necessary rights to present the respective artworks or products. Users have the opportunity to find and discover these artworks or products via a search function.

(3) The search functions include, in particular:

  1. Text-based search by entering search terms,
  2. Image-based search by uploading an image,
  3. Context-based search and recommendation by analyzing room images.

(4) The platform may use advanced technologies, including artificial intelligence, to analyze images, to categorize artworks or products, and to generate personalized recommendations. By using these functions, the user gives consent to the processing of the data provided for this purpose.

(5) All providers warrant that they hold the necessary rights for the presentation of the respective artworks or products.

(6) Lila reserves the right to expand, change, or discontinue the offered functions. Users will be informed in an appropriate manner about essential changes.

(7) Lila acts solely as an intermediary between providers and interested parties. The purchase, sale, shipping, and payment of the artworks as well as of the products, and any other related activities, are carried out exclusively between the users outside the platform.

(8) Lila assumes no liability for the transactions mentioned in Paragraph 7.
