Besondere Teilnahmebedingungen für das Creator-Programm der Lila GbR

1.1 These conditions govern participation in the affiliate program ("Creator Program") within the "Lila" app. They apply in addition to the General Terms of Use (AGB).
1.2 Participation is exclusively open to natural persons who:
a) have completed their 18th year of age,
b) are acting as entrepreneurs (commercially or as freelancers),
c) have their residence or registered business seat in the Federal Republic of Germany or another member state of the European Union (EU).
1.3 Participation by users based in third countries (outside the EU/EEA) is currently excluded.
2.1 In contrast to the limited license in § 4 of the General Terms of Use, the Creator grants Lila an extended right of use to the content uploaded within the scope of the Creator Program (photos, videos, texts).
2.2 The Creator grants Lila the non-exclusive, temporally, spatially, and content-wise unlimited right to use the content comprehensively, in particular to reproduce, distribute, make publicly available, and edit it.
2.3 This explicitly includes the right to use the content for commercial purposes, specifically for promoting the depicted products (e.g., by placing "tags" or affiliate links in the image) as well as for marketing measures by Lila on third-party platforms (e.g., Social Media Ads, Newsletters).
2.4 The Creator hereby waives his/her right to be named as the author (Section 13 German Copyright Act - UrhG), insofar as this is not customary in the industry or is technically difficult to implement within the scope of contractual use (e.g., in Social Media Ads or collages). However, Lila endeavors to mention the Creator's name or handle where possible.
3.1 Lila shall credit the Creator with remuneration ("Commission") if a third party makes a verified purchase at a partner shop via products tagged by the Creator.
3.2 The claim to the Commission arises only when:
